1. Acceptance of Terms
By accessing and using the services provided through Massapequa Tree Service (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.
2. Service Description
Massapequa Tree Service facilitates the arrangement of tree care services including but not limited to tree removal, tree trimming, stump grinding, emergency tree services, and related arboricultural services. All services are actually performed by Joe Tree Tree Service, an independent contractor.
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your property and service needs
- Grant necessary access to your property for service completion
- Clearly mark property boundaries and identify underground utilities before work begins
- Disclose any known hazards, concerns, or special requirements
- Secure pets and remove valuable items from the service area
- Pay all agreed fees in accordance with payment terms
4. Estimates and Pricing
- All estimates provided are approximations based on visual inspections
- Final pricing may vary if additional work is required or if conditions change
- Additional services requested during job execution will incur additional charges
- Estimates are valid for 30 days unless otherwise specified
5. Scheduling and Cancellations
- Service dates are approximate and may be affected by weather or other circumstances
- We require 48 hours’ notice for cancellations; shorter notice may result in cancellation fees
- Emergency services may take priority over previously scheduled work
- Rescheduling due to weather or unforeseen circumstances will be handled promptly
6. Payment Terms
- Payment methods accepted include credit cards, checks, and cash
- A deposit may be required before work commences
- Final payment is due upon completion of services
- Late payments will incur a 1.5% monthly interest fee on outstanding balances
- Returned check fee of $35 will apply to any dishonored payments
7. Warranty and Workmanship
- All work performed by Joe Tree Tree Service is guaranteed for 30 days after completion
- Warranty covers workmanship only, not acts of nature or subsequent damage
- Claims must be submitted in writing within the warranty period
- Warranty is void if client intervenes with or modifies the completed work
8. Liability Limitations and Disclaimers
8.1 Property Damage
- Joe Tree Tree Service takes reasonable care to prevent damage to client property
- We are not responsible for:
- Damage to unmarked utilities, septic systems, or irrigation systems
- Minor lawn or landscape damage that naturally occurs during tree work
- Damage resulting from preexisting property conditions
- Cosmetic damage to grass or plants from equipment or falling debris
- Acts of God occurring during service provision
8.2 Limitation of Liability
- Our total liability for any claims arising under these Terms shall not exceed the amount paid by the client for the specific services at issue
- Neither Massapequa Tree Service nor Joe Tree Tree Service shall be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not responsible for any delays or inability to perform due to circumstances beyond our reasonable control
8.3 Insurance and Indemnification
- Joe Tree Tree Service maintains appropriate liability insurance and workers’ compensation coverage
- Client agrees to indemnify and hold harmless Massapequa Tree Service and Joe Tree Tree Service from claims arising from client misrepresentation, negligence, or failure to disclose relevant information
8.4 Third-Party Claims
- Client is responsible for resolving any property line disputes or neighbor complaints
- Services performed at client direction that result in third-party claims are the client’s responsibility
9. Photo and Marketing Release
Unless otherwise specified in writing, client grants permission to Massapequa Tree Service and Joe Tree Tree Service to photograph work before, during, and after completion for promotional purposes including website, social media, and print materials.
10. Dispute Resolution
- All disputes shall first attempt to be resolved through good-faith negotiation
- Unresolved disputes shall be submitted to binding arbitration in Nassau County, New York
- The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs
- These Terms shall be governed by the laws of the State of New York
11. Severability and Assignment
- If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect
- Client may not assign their rights or obligations without prior written consent
- Massapequa Tree Service may assign its rights and obligations at its discretion
12. Tree Ownership and Permits
- Client represents that they are the owner of the property or have authorization to order services
- Client is responsible for obtaining any necessary permits or homeowner association approvals
- We reserve the right to refuse service if proper permits are not obtained
- Client confirms that all trees to be worked on are on their property or have appropriate permissions
13. Hazardous Conditions
- Our arborists may refuse to perform work if unsafe conditions exist
- Additional charges may apply if hazardous conditions are discovered after work begins
- We reserve the right to use specialized equipment or techniques to address hazardous situations safely
14. Termination of Services
We reserve the right to terminate services at any time if:
- Client violates these Terms
- Safety concerns arise that cannot be reasonably mitigated
- Client requests services that violate laws, regulations, or ethical arboricultural practices
- Property access becomes unreasonably restricted
15. Amendment of Terms
Massapequa Tree Service reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified Terms.
